    Recent Updates Re: The Americans With Disabilities Act 

    This presentation will cover several “hot topics” related to the Americans with Disabilities Act (“ADA”) including:

    • Website Compliance – is your company’s website accessible to those who are disable? Does it even need to be? This portion will cover those topics as well as how to bring your website into compliance and best practices.
    • Mental Health/Substance Abuse Issues – more and more employees are reporting some kind of mental health or substance abuse issue and company’s need to be prepared to respond – this portion will cover reasonable accommodations, drug testing, EAP programs, etc.

    Speaker Bio:

    Pierce T. (Perry) MacLennan is an Associate of Haynesworth, Sinkler, Boyd Attorneys and Counselors At Law.  Perry MacLennan acts as outside general counsel to private businesses, local governments and non-profit entities. He focuses particularly on employment compliance, regulatory matters, contracting and trial counsel. 

    Perry has a passion for employment law. Perry serves as nationwide chair for the Labor & Employment Law Committee of the American Bar Association Young Lawyers Division and regularly blogs about workplace issues at www.SCEmployersblog.com. He counsels employers on everyday compliance issues involving the ADA, FMLA, Title VII, OSHA, state law employment statues and other employment-related regulations. He also represents employers during discrimination, harassment and retaliation complaints before the EEOC and in complaints brought before the Department of Labor.

    An active litigator and appellate lawyer, Perry handles complex lawsuits involving federal and state employment law, business disputes, property disputes, trust & estate cases and much more. He has extensive experience with appeals and argued before the Supreme Court of South Carolina. 

    Background and Education:

    A proud graduate of Clemson University, Perry gives back to his alma mater through serving on the Clemson Young Alumni Council. Perry went on to become an accomplished law student at the University of South Carolina where he finished in the top 5 of his class, received multiple CALI awards for the top grade in a particular subject and served as Associate Editor-in-Chief of the South Carolina Law Review. He was a Law School Ambassador for the University. He was awarded the top overall score in the 2012 Law Review Journal Writing Competition.

    Prior to joining the firm, Perry worked for the South Carolina House of Representatives Labor, Commerce and Industry Committee. In this role, he gained valuable insight into the regulation and licensing of businesses in South Carolina. He also worked as a Research Assistant for a Professor Emeritus at the University of South Carolina School of Law, where he researched tort law for the new cumulative supplement of the South Carolina Law of Torts.

    Professional and Civic Activities:

    Perry is committed to giving back to the profession through his service with the American Bar Association and the South Carolina Bar. He has served in various leadership roles within the ABA Young Lawyers Division and has served as a South Carolina delegate to the American Bar Association House of Delegates. Within the South Carolina Bar Young Lawyers Division, he currently serves as co-chair for the Professional Development Committee and Make-a-Wish Committee; and as a member of the ICivics Committee and the Bar Convention Committee.

    Mr. MacLennan also serves on the executive committee of LEADSC, a statewide summit for young professionals and was a member of the Charleston Metro Chamber of Commerce Leadership Discovery Program, Class of 2016.
